Rental Agreeement

RENTAL RATE: The tenant hereby agrees to rent for the landlord, RESTIGOUCHE STORAGE, premises know as:
located at 353 Miller Blvd., Dalhousie, NB (hereinafter, called the premises),
on a monthly basis,
plus HST.

Payments are made in advance on the first day of each month by way of postdated cheques or credit card.

STORAGE LIMITATIONS: This unit shall be used for unheated storage. The tenant shall not introduce any heating device into the unit. The tenant shall not use or permit the unit to be used for the storage of flammable substance, fertilizers, explosives, animals, or any other hazardous materials, substances or other articles, which may constitute a nuisance, or danger to the Landlord, the premised and/or other tenants. The tenant shall not conduct any business from the unit.

TENANTS RISK: The tenant assumes all risk in relation to the loss or damage to the contents of the personal property of the tenant in the unit from any cause whatsoever. The tenant and the tenant on behalf of his insurer shall waive any right of subrogation to any claim that the tenant may make to the insurer or against the Landlord if any liability relating to the loss of or damage, to such contents or personal property. The tenant hereby agrees to indemnify the Landlord and to hold and save the Landlord harmless from any loss, damage, expense, or claim arising from the tenants act or omissions and the Landlord shall not be liable to the tenant for any loss or damage that may result from or through the act or omission or other tenants or any other person.

ARREARS OF RENT: If the rent is in arrears at least ten (10) days, or if unit is not vacated upon termination of this contract, the Landlord may deem the unit abandoned along with the contents, thereof and upon ten (10) days' notice in writing, sent by registered mail to the tenant at the above address. The Landlord may retake possession of the unit and shall sell the contents thereofto satisfy all monies due to the landlord for arrears of rent, cleaning and/or damage charges and costs.

ENTRY OF UNIT BYLANDLORD: The Landlord reserves the right to enter the unit without notice, for purposes of inspection whenever the Landlord deems that repairs are necessary, that any hazardous conditions exists, or for any other breach of this lease.

VACATING THE UNIT: When the tenant wishes to vacate the unit and terminate the contract, he/she shall notify the Landlord no less than 15 days prior as to when all contents will be removed from the unit including the tenants lock. The tenant needs to obtain a cancellation code from the landlord to confirm the vacancy. If the tenant fails to notify the landlord, they forfeit their security deposit. Should the tenant's rental period exceed midnight of the last day of the month or midnight of the day proceeding the monthly rental period an additional monthly charge will be applied. Units are considered still occupied until keys and lock have been returned and are inside the unit.

NOTIFICATION OF ADDRESS CHANGE: The tenant is responsible for notifying the Landlord of any address and telephone number change subsequent to contract being signed.

REMOVAL OF OVERLOCK: Rental is from the 1st day to the last day of the Month or contract period. Removal of overlock, or replacement of lost keys could take up to 48 hours. There is a service charge of $35. to replace the key.

LATE PAYMENT CHARGE: Payments made after the 5th of every month are subject to a $25.00 administration charge. Should the Landlord proceed with lock-out action a $50.00 charge will apply, plus all cost incurred. N.S.F CHEQUES: All N.S.F Cheques are subject to a $40.00 charge.

CANCELLATIONS: Two month rental period minimum for all units. No refunds. Repayment of promotional discounts required if you cancel service before the promotional period ends(ie. If you get one month free for one year of renting you will have to pay for the two months if you leave before the 12 month period).

SECURITY DEPOSIT: Upon Signing this lease, the tenant shall pay a security, key, cleaning and damage deposit of $100 CAD. This deposit shall be returned to the tenant within (15) days after unit is vacated, provided that the Landlord may retain any amount necessary for compensation for arrears of rent, cleaning and / or damage costs.

Important!! By making payment and taking possession of the unit you accept the terms and conditions of this contract, making this a legally binding agreement.
